Buying Process
In Spain, individuals can apply for a mortgage through a bank. Spanish nationals and residents may be able to obtain financing of up to 90% of the property’s purchase price, while foreign and non-resident buyers may be eligible for financing of up to 70%. To apply for a mortgage in Spain, you will generally need to demonstrate a stable and consistent source of income.
In addition to the purchase price, you should bear in mind that in Andalusia a 7% tax generally applies to resale properties, while new-build properties are generally subject to 10% VAT. You should also allow for other costs such as legal representation, notary fees and Land Registry fees, where applicable.

This is not only about negotiating the price with the seller; we may also agree on other important aspects of the transaction, such as furniture, the timeframe for signing the deposit agreement and completing at the notary, and how certain costs will be handled. - STEP 2 — DEPOSIT AGREEMENT (ARRAS OR PPC): Once the terms have been agreed, both parties sign a formal agreement setting out the conditions of the sale. At this stage, the buyer will typically pay 10% of the property price as a deposit, formalising their commitment to the purchase.
- STEP 3 — NOTARY: Once the agreed timeframe has passed and the buyer has the necessary funds available — whether through their own funds or mortgage financing — the sale is completed by signing the public title deed before a notary. Although this stage can sometimes feel intimidating, it is usually the simplest part of the process.
